Terms of Service
Effective October 20, 2026 ยท Version 2026-10-20
MusicTheory.Work is operated by Criston Jackson, located in Arkansas, United States ("we", "us", or "our"). Contact us at jacksoncris44@gmail.com. These Terms govern the hosted service at https://musictheory.work and its installed web app. The Privacy Policy explains our handling of personal information.
1. Agreement and eligibility
By selecting the agreement checkbox and continuing with Google, you agree to these Terms and acknowledge the Privacy Policy. Cloud accounts are available to people 13 or older. If you are under 18, your parent or legal guardian must review and agree to these Terms with you before you sign in. The parent or guardian agrees to supervise your use and is responsible for that use to the extent permitted by law. Do not create an account for a child under 13. Lessons and local guest features have no minimum age requirement. You may use the lessons without an account; guest learning progress stays on that browser unless you choose to sign in.
If you use the service for an organization, you confirm you can bind that organization. If you do not agree, do not create an account or use optional cloud or AI features.
2. Accounts and cloud storage
Google authentication provides your account identity. Keep your Google account secure, sign out on shared devices, and tell us about unauthorized access. Signing in merges guest progress from the current browser into your account, including completed lessons and best scores, and enables cloud progress synchronization.
Cloud sync and browser storage can fail or be unavailable. Keep exports of work you want to retain. You are responsible for the material you upload and for ensuring you have permission to use it.
3. Permitted use
- Use the service lawfully and respect the rights, privacy, and safety of others.
- Do not upload content you lack permission to use, abuse the service, distribute malware, attempt unauthorized access, bypass security or provider safeguards, or disrupt others' use.
- Do not impersonate others or use the service to infringe intellectual property, facilitate fraud, or engage in unlawful conduct.
We may limit or suspend access where reasonably necessary to address abuse, security, legal obligations, or service availability. Where practical and lawful, we will explain significant account restrictions and provide a way to contact us.
4. Your work and third-party materials
The course, illustrations, branding, and software are protected by applicable intellectual property rights. You may use the course for personal learning. Any applicable open-source license governs use of the code separately from the hosted service; it does not grant rights to third-party assets or trademarks. You retain rights in any original material you create.
5. Educational service
MusicTheory.Work provides educational exercises and tools. Content, timing estimates, audio examples, and automated grading may contain errors. Your progress and scores are learning aids, not accredited qualifications. Adjust playback to a comfortable volume.
6. Fees, links, and other services
The hosted app currently has no subscription fee. External links, including links between MusicTheory.Work and Vibe, lead to services with their own terms and privacy practices. We do not control those providers. Any future paid offering will disclose its price and separate purchase terms before you agree.
7. Service availability and warranties
To the extent permitted by law, the service is provided "as is" and "as available", without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or error-free operation. We may change features or discontinue the service. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
8. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive losses, or lost profits or data, arising from use of the service. Our total liability for claims connected to the service is limited to the greater of US $100 or the amount you paid us for the service in the 12 months before the event giving rise to the claim. These limits do not apply to fraud, intentional misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence, or any liability or statutory right that the law does not allow us to exclude or limit.
9. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless the operator and its personnel from reasonable third-party claims, damages, liabilities, and reasonable legal costs arising from your unlawful use of the service, your material breach of these Terms, or content you submit that infringes another person's rights. This obligation applies only to the extent the claim is caused by your conduct; it does not cover our own negligence, misconduct, or breach of law. We will give you reasonably prompt notice of a claim and reasonable cooperation. No settlement may admit fault on your behalf or impose a non-monetary obligation on you without your consent, which will not be unreasonably withheld.
10. Ending use and deletion
You may stop using the service at any time, sign out, and clear local browser data. You can export progress in Settings before clearing it. Request cloud account and data deletion through jacksoncris44@gmail.com, using your account email when possible. We verify requests to protect accounts. Signing out alone does not delete cloud data or copies on your devices. Obligations that by their nature survive termination, including accrued claims and the liability and indemnification provisions, continue to apply.
11. Changes, law, and contact
We will post the current Terms and effective date here. Material changes affecting account use will require renewed agreement before a later sign-in. Changes apply prospectively. The laws of Arkansas, United States govern these Terms, subject to any mandatory laws and consumer protections of your place of residence. Nothing requires you to waive a mandatory local forum or statutory remedy. If one provision is unenforceable, the rest remain in effect to the extent lawful. Questions, account appeals, privacy requests, and intellectual property complaints can be sent to jacksoncris44@gmail.com.
